就现有宠物科学饲养和保护的立法情况而言，国内尚未制定一般性的宠物饲养规范，虽然野生动物保护法、畜牧法、实验动物管理条例等已针对野生动物、实验动物等特殊动物做了规定，但对于宠物的专门立法尚未完善。目前，只能依据地方性的限养、登记等制度和标准规定来管理，导致多年来围绕宠物的繁殖、饲养、流浪动物处理等活动缺乏明确的法律依据。
