但实践中，犬只饲养者或管理者对犬只的管理是否存在故意、过失或者不作为取证相当难，这就导致责任界限极其模糊、司法标准不清晰。没有明确刑事责任方面的条文，难以追究犬只饲养者或管理者的刑事责任，导致绝大多数犬只伤人案件只能以追究犬只饲养者或管理者的民事责任而终结。
